Policy Landscape Shifts

Despite public wariness, recent regulatory actions have moved toward greater inclusion of alternative assets, including digital assets, in retirement accounts. In May 2025, the U.S. Department of Labor rescinded guidance that urged extreme caution for crypto investments, adopting a neutral stance. An executive order signed on August 7, 2025, directed agencies to consider regulatory changes to facilitate access to alternative assets in defined‑contribution plans.

In March 2026, the Labor Department proposed rules that would allow 401(k) fiduciaries to add alternative assets, offering safe harbors to mitigate litigation risk while requiring assessment of fees, liquidity, valuation and performance. The proposal has faced criticism from lawmakers, including Senators Bernie Sanders and Elizabeth Warren and Representative Bobby Scott, who urged withdrawal of the rules due to concerns over crypto volatility and investor protection.

Survey Methodology

The survey was conducted by Greenwald Research between October 24 and November 14, 2025, with 1,203 U.S. adults aged 25 and older. Results were weighted by age, gender and income.
