California lawmakers approve bill banning meme coins issued by public officials

California’s legislature has approved Assembly Bill 2409, a measure that bars state and local elected or appointed officials, as well as certain public employees, from issuing meme‑style digital tokens. Prohibition on officials issuing meme coins

Under AB 2409, a public officer or employee may not "issue" a meme coin – defined as making a token available for purchase, donation or exchange for any value – regardless of whether the token is promoted. The definition of a public officer includes state and local elected or appointed officials, members of the California Legislature, and members of government boards, commissions, committees and advisory bodies. The employee provision applies to staff with decision‑making authority over bids and contracts.

Future restrictions on digital‑asset service providers

Effective January 1, 2027, a digital‑asset service provider may not list for sale or facilitate purchase by a California resident of a meme coin issued on or after that date when the token is offered by, or in partnership with, a covered public official – including federal officials. The restriction targets only official‑linked meme coins and does not constitute a blanket ban on meme‑coin trading in the state.

Enforcement mechanisms

The California Attorney General can file civil actions seeking injunctions and disgorgement against violators. District attorneys, city attorneys and county counsel may also enforce the prohibition and pursue similar remedies.
