Thailand’s Securities and Exchange Commission (SEC) released a draft rule on Aug. 31 that would let licensed intermediaries offer retail investors access to certain crypto‑derivative contracts traded on foreign exchanges.
Eligibility criteria for retail contracts
Only contracts that closely resemble products permitted in Thailand may be offered to non‑institutional clients. The SEC said the comparison will consider the underlying asset, contract maturity, leverage, delivery method and settlement structure. Overseas exchanges must use a regulated central counterparty (CCP) and be supervised by a regulator that is a Signatory A to the IOSCO Multilateral Memorandum of Understanding or a member of the World Federation of Exchanges.
Scope of the proposal
The draft covers retail, high‑net‑worth and ultra‑high‑net‑worth investors. Contracts that do not meet the similarity test would remain available only to institutional investors, who are deemed better equipped to handle the risks of leverage, volatility and settlement.
Implementation timeline and next steps
The public consultation runs until Sept. 30. The SEC has not set a date for the final rules or identified which foreign exchanges or contracts will qualify. The Thailand Futures Exchange (TFEX) is still working on domestic crypto‑derivative specifications, which will serve as the benchmark for the similarity assessment.
Broader regulatory context
Earlier in 2026, Thailand amended its Derivatives Act to allow cryptocurrencies and digital tokens as underlying assets for regulated futures and options. The SEC is also considering a licensing framework that would let crypto businesses obtain derivatives licences without creating separate corporate entities, and it is developing rules for crypto exchange‑traded funds and spot Bitcoin/Ether ETFs.
