Saylor says stalled CLARITY Act could boost Bitcoin activity

Strategy Executive Chairman Michael Saylor predicts that the CLARITY Act’s defeat in the Senate could redirect capital toward Bitcoin as U.S. regulators continue rulemaking under existing authority.

Strategy Executive Chairman Michael Saylor said the recent Senate vote that stopped the CLARITY Act from advancing may open new avenues for Bitcoin investment. He argued that regulators can move forward with rules using existing law, and that banks could expand Bitcoin custody and lending services.

CLARITY Act vote outcome

The Senate failed to invoke cloture on the CLARITY Act, voting 49‑50. With a 60‑vote threshold, the motion fell 11 votes short, preventing the bill from proceeding to full debate. The legislation, which had passed the House and cleared the Senate Banking Committee, aimed to clarify federal authority over digital assets, dividing oversight between the SEC and CFTC.

Saylor’s outlook for Bitcoin

Saylor posted on X that, with the bill stalled, the SEC, CFTC, and Treasury are likely to advance rules under their current powers. He expects regulated banks to add more Bitcoin custody options and to offer loans backed by Bitcoin, creating additional channels for capital to flow into the market.

Industry expectations on agency action

Coinbase CEO Brian Armstrong and analysts at Bernstein echoed Saylor’s view, noting that the SEC and CFTC already possess tools to issue rules without new legislation. Bernstein highlighted potential focus areas such as token classification, decentralized finance, self‑custody, and tokenized assets.

Broader regulatory context

While the CLARITY Act remains pending, the GENIUS Act has already established a framework for payment stablecoins, with the Treasury and OCC issuing proposed rules. The ongoing regulatory environment suggests that Bitcoin‑related services could expand even without a new congressional mandate.
